If you can do it safely, keep the police report number, names of witnesses, and photographs of the scene, the other vehicle, and the bicycle. Keep the bicycle. Do not throw it away or have it repaired before anyone has looked at it. If you have GPS, a bike-computer file, or camera video from the ride, keep that too.

Questions worth asking

  • If a car, taxi, bus, or truck was involved, ask about no-fault for medical bills and lost pay.
  • Damage to the bicycle is a separate question from a bodily injury.
  • Who had the right of way depends on the facts.
  • A city roadway condition may or may not be part of the claim. Deadlines involving a city can be short. Call promptly and ask about the timing that applies to your facts.
  • A defect in the bicycle itself is a different question from a crash with a driver.

New York Vehicle and Traffic Law section 1214 addresses opening the door of a motor vehicle on the side available to moving traffic, until it is reasonably safe, and leaving that door open longer than needed to load or unload.
